Legal Custody vs. Physical Custody

In Pennsylvania, child custody rights are generally divided into two categories:

  • Physical custody refers to the parent or third party with whom the child primarily resides.
  • Legal custody refers to decision-making power regarding the medical care, religion, education and general upbringing of the child. If legal custody is shared, both parents have the right to be present at medical appointments, parent-teacher conferences and important religious events, even if the parents are not of the same religion.

It is possible to arrange a custody plan that involves any combination of physical and legal custody. For example, parents often share joint legal custody, while one parent has primary physical custody and the other has ample "partial custody" (formerly known as visitation). A custody plan can be as specific as the parties desire and can detail where the child spends weekends and holidays, and how the child will be transported from one parent to the other.

If parents are unable to agree on a child custody plan, courts will consider a number of factors to determine a custody arrangement that is in the best interests of the child.
