The main differentiator between a civilian and military divorce is the military pension. A military member will receive a retirement pension after 20 years or more of active service. There are several factors that can affect if or how a military pension is divided, including:

  • The length of the marriage: If the couple was married 10 years or longer, the nonmilitary spouse is often entitled to half of the pension.
  • The overlap of military service and the marriage: If the overlap is small, or the service member spent many years in the military before getting married, it is possible that only a small portion of the pension will be considered marital property.
  • Years of military service: If the divorce takes place before the end of the service member’s career, the nonmilitary spouse may be entitled to less of the pension.
  • The needs of each spouse: Dividing a pension is not always the best option. Some spouses choose to accept certain assets or alimony instead of seeking part of a military pension.
