What circumstances allow modification of spousal support?

For example, if you lose your job through no fault of your own, you may request a reduction in your payment obligation. Similarly, if your former spouse obtains a high-paying job, you might seek to lower or terminate support.
Remarriage affects different types of support differently. If you are paying post-divorce alimony and your former spouse remarries, the obligation terminates automatically. This does not apply if you are paying alimony pendente lite (APL) during divorce proceedings.
How can you request a modification?
Spousal support modifications do not happen automatically. A formal petition must be filed with the court that issued the original support order. The court will then review the request and evaluate the evidence presented.
During this process, you must demonstrate the reason for the modification to the court. This may require documentation such as tax returns, medical records or employment termination letters. You cannot stop paying or expect changes without court approval.
Can your spouse contest your request?
The receiving spouse has the right to oppose any modification petition. After filing a modification petition, the former spouse will receive notice of the petition. They can then respond by challenging the claims or presenting counter-evidence. The court will weigh all evidence from both sides before deciding whether to grant the modification request.
